UPDATE ABOUT THE 2008 CALIFORNIA "CLEAN TRUCK" PROGRAM

New Requirements, New Fees!

Dear Customers and Friends of Seajet!

Earlier this month, my colleague Andreas Bauermeister wrote to all of you about the newly implemented California "Clean Truck" program, which will be administered by PortCheck Inc.

The ink has barely dried and already, we have been informed about a delay in the implementation of this California state program, which does apply to all containers moving through the ports of Los Angeles and Long Beach.

This "Clean Truck" program has generated a lot of opposition. Several law suits are pending in court and the Federal Maritime Commission (FMC) is involved now, too.

The notice we received earlier today is headlined:

"Clean Truck Fee Collection Delayed Pending Resolution of Regulatory Issues" with a by-line stating "Cargo Owners Urged To Complete Fee Payment Preparations".

What this means is, that the State of California is confident that they will prevail and that the "Clean Truck" program will ultimately go into effect and soon.

In the meantime, technical preparations for the fee collection continue. The new start date for fee collection is not yet clear, but "PortCheck Inc." strongly urges the parties concerned, to complete preparations for paying the CTF online.

As your representative, Seajet has done this already and we are now waiting to be told when CTF collection will commence.

We shall keep you posted.

Best regards,

Ronald W Hiemann, CEO
